You wouldn't expect to stay out of trouble for that now, would you RE: open source games you play? - edh - 05-20-2012 That would be a very different group of people who's game you would mod if you want to pick World of Warcraft. id has been on the side of modders for 20 years and we've had things like Doomsday, Quakerally, Action Quake, Action Quake 2, Voxelstein 3D etc making use of their names in a mod. A little leeway given for derivative fan works isn't too uncommon if you're not making money on it. Take a look at Star Wreck: In The Pirkinning as an example! Imagine if Nexuiz and Xonotic had Quake in the title, that's all it's like. Now if you wanted to make money on a commerical game that's derived then they might look at it differently. id used to have a problem with people selling Doom Wads although at a time before fast (or any) Internet connections were prevalent you would always find adverts in the back of PC magazines for massive lists of CDs with Doom WADs, C&C levels, porn... All at somewhat more than cost price. What matters is that they are competing with the original product by using its own name or something similar. I don't think C&D notes are mandatory, but they are a convenient way to let the infringer know they are taking risks. Lawsuits are expensive, while a C&D isn't and has a good chance to work. Of course it would be a bad PR move if id Software started doing this. But we're talking in general terms now, aren't we? Some other publishers are merciless in that respect.
