I sometimes find myself playing a quick match of Teeworlds. I used to play some Tremulous before nexuiz 2.3, and a ton of Armagetron Advanced.

Quake2World, though I barely have enough time for Xonotic these days.

Even worse, the name is dangerously close to that of QuakeWorld.

well, technically the name isn't quake, it's quake2world(all one word). I'm assuming that's how they get away with it.

It's one "2" away from QuakeWorld. Very very likely to infringe on the trademark.

Well, it was just a guess. I have no idea about trademarks and whatnot.

Just think what would happen if you made a game called "World Of War2craft". You wouldn't expect to stay out of trouble for that now, would you Tongue

That would be a very different group of people who's game you would mod if you want to pick World of Warcraft.

id has been on the side of modders for 20 years and we've had things like Doomsday, Quakerally, Action Quake, Action Quake 2, Voxelstein 3D etc making use of their names in a mod. A little leeway given for derivative fan works isn't too uncommon if you're not making money on it. Take a look at Star Wreck: In The Pirkinning as an example! Imagine if Nexuiz and Xonotic had Quake in the title, that's all it's like.

Now if you wanted to make money on a commerical game that's derived then they might look at it differently. id used to have a problem with people selling Doom Wads although at a time before fast (or any) Internet connections were prevalent you would always find adverts in the back of PC magazines for massive lists of CDs with Doom WADs, C&C levels, porn... All at somewhat more than cost price.

I play Red Eclipse Xonotic, and OpenArena mostly (even if I'm terrible at all of them), but since my mouse broke( been too busy to get it replaced) I've been playing more keyboard oriented games :
Warzone2100
Widelands
Armagetron Advanced
FreeCiv.

I've been meaning to get into playing Zero-K at some point, but I'm so rubbish at games, that I've never bothered

If you ever do check it out, you should play with me. Joining some random match, with people that have likely played it for much longer (and therefore are much better) is daunting!

But id still has trademarks and could enforce this. Even if they are known not to, my point is that they still have the right to sue.

That's different, it's protected by parody laws.

Anyway, I guess we're a bit offtopic there. Back on topic? Tongue

Could they actually sue though, if no money is being made of the infringement? Perhaps they could issue a cease and desist, but I don't think they can sue. And if they can, they would knowingly burn the mod community, possibly shooting themselves in the foot.

The income of the infringer doesn't matter. What matters is that they are competing with the original product by using its own name or something similar.

I don't think C&D notes are mandatory, but they are a convenient way to let the infringer know they are taking risks. Lawsuits are expensive, while a C&D isn't and has a good chance to work.

Of course it would be a bad PR move if id Software started doing this. But we're talking in general terms now, aren't we? Some other publishers are merciless in that respect.

Just gave Red Eclipse a try — it was surprisingly fun. I think it's my favorite open source game now XD... Can't believe I never heard of it before...

Quake2World on the other hand is pretty much dead.

Now to try out the other ones mentioned Big Grin
